Steps of the Probate Process When There Is No Will, Part Three

As we mentioned previously, once the court appoints a personal representative to act on the deceased’s behalf, information needs to be gathered regarding belongings and assets, surviving family and heirs, the value of assets, legal disputes, debts or taxes owed, other expenses that need attention and more. All of these factors should be documented.
Once this has been done, the court may then focus on who should be deemed beneficiaries for the estate. They will review heirs listed and make decisions regarding surviving children, spouses, or close relatives. Distant family may only be considered as beneficiaries should there not be any surviving children, spouses, or close relatives.
The next step should be choosing what assets may be distributed and to whom. This may be determined by state laws, as all states have varying laws. In some cases, there could be assets distributed to heirs without probate, especially if there is a property owned jointly between the deceased and another party. Again, this may be determined by specific state laws.
Passing without an estate plan in place can leave your family with a lengthy process that is overwhelming and confusing. It can take time to get everything processed and settled.
