A company can get a trademark by simply using their design or logo. If a company offers a service rather than a product, they can register a servicemark, which serves the same purpose. It is denoted as “SM.” Because it hasn’t been registered, there are limitations in what a company can enforce legally.
If a company wants to go a step further to protect their brand, they can register it with the U.S. Patent and Trademark Office. This will provide extra protection and help enforce legal rights if an issue arises. Once it’s registered, the company would use the registered trademark symbol, the letter “R’ with a circle around it, or ®.

A company that thinks their brand may already exist should hire a lawyer to search the trademark database.
